Mobility (Legal) Infrastructures

As part of the "Mobility (Legal) Infrastructures" workshop on December 5, Prof. Dr. Hoffmann presented the concept of legal infrastructures and infrastructuring processes as a central analytical framework for understanding the complex dynamics of migration and border regulation in South America. The lecture focused on this region as an exemplary area of study, where tensions between the rule of law and non-linear migration dynamics become particularly evident. Mobility is analyzed as a contingent and temporally dynamic interplay of fragmented legal regimes that extends beyond state control mechanisms.The research centers on the legal infrastructure of mobility, foregrounding the agency of migrants. It explores how migrants, through their interaction with the fragmentations and gaps in existing legal regimes, open alternative pathways for action. The project advocates for a shift in perspective toward a mobility-centered analysis that not only addresses the causes of displacement but also captures the everyday dynamics of being on the move. Empirical case studies, including the Venezuelan refugee crisis and Operation Shelter in Brazil, illustrate how mobility is shaped through the interactive transformation of fragmented legal orders.
